Agreement to These Terms
These Terms of Service (“Terms”) form a binding agreement between Cascade AI Systems (“Cascade,” “we,” “us,” or “our”) and the person or business (“you,” the “Client”) that accesses or uses our websites, the Lead Rescue platform, and related services (together, the “Service”).
By creating an account, clicking “I agree,” or otherwise accessing or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service
Cascade AI Systems operates Lead Rescue, a missed-call text-back automation platform for home-service and trades businesses (such as plumbing, HVAC, electrical, roofing, and restoration companies). When an incoming call to your business goes unanswered, the Service automatically sends an SMS text message to the caller from your business’s own registered phone number, helps capture the lead, and can assist with scheduling appointments.
Messages sent through the Service are transactional and conversational — they are automated responses to a consumer who has just called your business. The Service is not designed for, and you may not use it for, bulk or promotional marketing campaigns. We may add, modify, suspend, or discontinue features of the Service at any time.
Accounts & Eligibility
To use the Service, you must be at least 18 years old, operate a legitimate business, and provide accurate and complete account and billing information. You are responsible for:
- Maintaining the confidentiality of your account credentials;
- All activity that occurs under your account;
- Ensuring the phone numbers, business name, and information you register are accurate and that you are authorized to use them; and
- Promptly notifying us of any unauthorized use of your account.
You may not share, sublicense, or resell your account or the Service without our prior written consent.
Messaging & Consent
This section governs the SMS text messaging functionality of the Service and your responsibilities under U.S. messaging laws and carrier requirements.
SMS Program Disclosures
- Program: Lead Rescue sends automated text messages on a Client’s behalf to consumers who call the Client’s business and do not reach a live person.
- Message frequency: Message frequency varies and depends on call volume and the resulting conversation. Messages are conversational and triggered by a consumer’s inbound call.
- Cost: Message and data rates may apply, depending on your mobile carrier and plan.
- Opt-out: Reply STOP to any message to unsubscribe at any time. Reply HELP for help. Opt-out is honored immediately, and no further messages will be sent to that number except a single confirmation that you have been unsubscribed.
- Carriers: Mobile carriers are not liable for delayed or undelivered messages.
Your Consent Obligations (TCPA / CTIA / A2P 10DLC)
As a Client, you represent and warrant that you have obtained, and will maintain, all consents and permissions required by applicable law to send text messages to the consumers and callers you contact through the Service. This includes compliance with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and all applicable A2P 10DLC requirements.
Because Lead Rescue replies to consumers who have voluntarily placed a call to your business, those messages are responses to a consumer-initiated contact. Nonetheless, you are solely responsible for ensuring your use of the Service complies with all applicable messaging laws, regulations, and carrier requirements, and that you have a lawful basis to text each recipient.
A2P 10DLC Registration
Messages sent through the Service are delivered over registered Application-to-Person (A2P) 10DLC campaigns via our messaging provider, Twilio, and The Campaign Registry (TCR). You agree to provide accurate brand and campaign information for this registration and to use the Service only for the registered, approved use case.
Opt-Out Handling
The Service automatically recognizes and honors standard opt-out keywords — including STOP, UNSUBSCRIBE, CANCEL, END, and QUIT — and responds to HELP requests. We maintain opt-out records to prevent future messaging to numbers that have unsubscribed. We do not sell, rent, or share consumer phone numbers for third-party marketing.
Prohibited Message Content
You may not use the Service to send messages that contain content prohibited by mobile carriers or the CTIA, including content related to sex, hate, alcohol, firearms, or tobacco (the “SHAFT” categories), or any unlawful, deceptive, harassing, or misleading content.
Messaging Indemnity
You agree to indemnify and hold Cascade harmless from any claims, fines, penalties, or damages arising from your failure to obtain required consent or your violation of any messaging law, regulation, or carrier requirement in connection with your use of the Service.
Acceptable Use
You agree not to use the Service to:
- Violate any law, regulation, or carrier or messaging requirement;
- Send spam, unsolicited bulk messages, or marketing to recipients who have not interacted with your business;
- Send content in the prohibited SHAFT categories or any harassing, abusive, deceptive, or fraudulent content;
- Infringe the intellectual property or privacy rights of others;
- Impersonate any person or business, or misrepresent your identity or affiliation;
- Attempt to gain unauthorized access to, interfere with, or disrupt the Service or its underlying systems; or
- Resell or commercially exploit the Service without our written authorization.
We may investigate suspected violations and may suspend or terminate access for conduct we reasonably believe violates these Terms or creates risk or legal exposure.
Plans & Billing
Paid plans are billed on a recurring subscription basis (monthly or annual, as selected at signup) through our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.
- Recurring billing: Your subscription automatically renews at the end of each billing period at the then-current rate, unless cancelled before the renewal date.
- Pricing changes: We may change our fees with reasonable advance notice. Changes apply to the next billing cycle after the notice.
- Cancellation: You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you retain access until then. We do not provide prorated refunds for partial periods unless required by law.
- Refunds: Except where required by law or expressly stated in writing, fees are non-refundable. Any free-trial terms are described at signup.
- Failed payments: If a payment fails, we may suspend or downgrade your access until payment is resolved.
- Taxes: You are responsible for any applicable taxes other than taxes on our net income.
Third-Party Services
The Service depends on third-party providers to function. Your use of the Service may be subject to their terms, and we are not responsible for the acts, omissions, availability, or performance of these providers:

Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that messages will be delivered on time or at all — message delivery depends on mobile carriers and third-party networks outside our control. You are responsible for evaluating whether the Service is appropriate for your business.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASCADE AI SYSTEMS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Termination
You may terminate your account at any time by cancelling your subscription. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, fail to pay fees when due, or create legal, security, or carrier-compliance risk.
Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive — including outstanding payment obligations, messaging indemnity, disclaimers, limitation of liability, and governing law — will survive termination. Account and data handling after termination is described in our Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Washington will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where prohibited by applicable law.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to business clients or by posting the updated Terms with a revised effective date at cascadeaisystems.com/terms.html. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
